1. GENERAL PROVISIONS

1.1. This Public Offer Agreement (hereinafter "Agreement") is a public offer by ForgeMaster Community (hereinafter "Service Provider") addressed to any individual or legal entity (hereinafter "User") to use the ForgeMaster audio mastering platform.

1.2. By using the Service, making any payment, or accepting this Agreement in any other manner, the User confirms full and unconditional acceptance of all terms herein.

1.3. This Agreement is governed by the principles of international commercial law, including the UNIDROIT Principles of International Commercial Contracts.

2. SUBJECT OF THE AGREEMENT

2.1. The Service Provider grants the User access to the ForgeMaster audio mastering platform, which provides automated audio processing, equalization, compression, limiting, noise reduction, and format conversion services.

2.2. The Service is provided on an "as-is" and "as-available" basis. No warranty, express or implied, is made as to merchantability, fitness for a particular purpose, or uninterrupted operation.

3. VOLUNTARY DONATION NATURE OF PAYMENTS

3.1. All monetary contributions made through the Service are strictly voluntary donations in support of the ForgeMaster open-source community. These contributions do not constitute payment for services or subscription fees in the legal sense.

3.2. Contributors acknowledge that enhanced features unlocked following a donation are a gesture of appreciation from the community, not a contractually guaranteed service deliverable.

3.3. Suggested donation amounts: $1.00 (single session), $100.00 per month, $1,000.00 per year. These amounts are guidance only.

3.4. Donations are non-refundable except where required by applicable consumer protection law.

4. LIMITATION OF LIABILITY

4.1. To the maximum extent permitted by applicable law, the Service Provider shall not be liable for any direct, indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, profits, business, goodwill, or any other intangible loss.

4.2. The Service Provider's total aggregate liability shall not exceed the total amount of donations made by that User in the preceding 90 days.

5. FORCE MAJEURE

5.1. Neither party shall be liable for any failure or delay in performance caused by circumstances beyond that party's reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, pandemics, government actions, internet outages, cyberattacks, power failures, or equipment failures.

5.2. No party bears any responsibility for damages, losses, or costs arising from a force majeure event.

6. INTELLECTUAL PROPERTY

6.1. The User retains all intellectual property rights to audio content uploaded to the Service.

6.2. The User grants the Service Provider a limited, non-exclusive, royalty-free license to process the audio content solely for the purpose of providing the Service.

7. DISPUTE RESOLUTION

7.1. Any dispute that cannot be resolved through negotiation within 30 days shall be submitted to binding arbitration under the UNCITRAL Arbitration Rules.

8. AMENDMENTS

8.1. The Service Provider reserves the right to modify this Agreement at any time. Continued use of the Service after publication of changes constitutes acceptance of the new terms.
